1. Introduction

These Terms of Service (“Terms”) govern your use of Playnist OÜ (“Playnist,” “we,” “our,” or “us”) and our platform, websites, and related services (collectively, the “Service”).

By accessing or using Playnist, you agree to these Terms. If you do not agree, you must not use our Service.

2. About Playnist

Playnist is a social cataloguing platform for gaming, allowing users to track games, share their experiences, and connect with others.

3. Eligibility

  • You must be at least 13 years old to use Playnist.
  • If you are under 18, you confirm that you have permission from a parent or legal guardian to use the platform.
  • By creating an account, you confirm that you meet these requirements.

4. Accounts

We collect data in the following ways:

  • To access the platform, you will need to create an account.
  • You must provide accurate, current information and keep your login credentials secure.
  • You are responsible for all activity on your account.

5. User-Generated Content (UGC)

Playnist is built around the content shared by our community. This section explains how your content is used, what rights you retain, and how we may use it within the Service.

  1. Ownership
    You retain ownership of all content you create or upload (“User Content”).
  2. License to Playnist
    By posting User Content on Playnist, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to:
    • Display and feature it within the Service (including curated feeds like Discover)
    • Use it in Playnist’s marketing and promotional materials (e.g., email, social media, campaigns)
    • Integrate it into Playnist features, partner integrations or APIs that support the Service
  3. This licence may continue for a limited period after you delete your content or account, only where necessary for technical, legal or operational reasons (such as backups or compliance).
  4. Responsibility
    You are solely responsible for your User Content. You confirm that your contributions are original and do not infringe any third-party rights and comply with applicable laws and regulations. Plagiarism, spam, duplicate accounts, or misleading content are prohibited. Playnist reserves the right to edit, remove, or refuse any content and suspend associated accounts if needed.

6. Community Guidelines

To foster a safe and welcoming community, you agree to:

  • Be respectful of other users and avoid harassment, hate speech, or discrimination.
  • Refrain from spamming, phishing, or malicious activities.
  • Not attempt to reverse-engineer, hack, or disrupt the platform.

We reserve the right to moderate, edit, or remove content and suspend accounts that violate these guidelines or harm the Playnist community.

You may use Playnist for personal only. You may not reproduce, resell, or utilize Playnist content for commercial gain without our prior written consent.

You must not use Playnist for the purpose of gaming our platform, manipulating engagements, using bots, or creating duplicate accounts. Actions intended to artificially inflate interactions or metrics are strictly prohibited.

7. Beta Access Disclaimer

Playnist is currently in Beta Access, which means you’re helping shape the platform as it grows. By using Playnist, you agree that:

  • Features are experimental: Beta or early-access features may be incomplete, unstable, contain bugs, or undergo significant changes (including removal) without notice.
  • Limited reliability: Beta features may cause unexpected behaviour, downtime, or data loss. We are not responsible for any loss of data, disruptions, or other issues arising from use of beta features.
  • Feedback may be used: By using beta features, you grant us permission to collect feedback, usage data, and error reports to help improve the Service.
  • Discontinuation: We may modify, suspend, or discontinue the Service (or any part of it) at any time without liability.

Using Playnist during this phase means accepting that it’s a work in progress, and we’re excited to have you as part of the journey!

8. Intellectual Property

  • The Playnist platform, branding, logo, design, and software are owned by Playnist OÜ.
  • Playnist, our logo, and associated brand elements are trademarks of Playnist OÜ. You may not use our name, trademarks, or branding without our prior written permission, except as allowed under fair use or platform features (e.g., sharing links to your Playnist profile).
  • You may not copy, modify, or distribute our branding or proprietary code without permission.

9. Third-Party Services

Playnist may link to or integrate with third-party services (e.g., hosting providers, analytics tools, Meta for marketing). We are not responsible for third-party content, terms, or privacy practices.

Playnist uses game metadata provided the Internet Game Database (IGDB) API, to display game information and imagery. All such content remains the property of IGDB or its licensors. Playnist is not responsible for errors, omissions, or changes in third-party data.

10. Termination

We may suspend or terminate your account if:

  • You violate these Terms,
  • Engage in unlawful or harmful activity, or
  • Misuse Playnist in a way that threatens other users or the platform.

You may request account deletion at any time by contacting us.

Playnist reserves the right to remove any User Content that violates these Terms, and to suspend or terminate user accounts at its discretion, particularly for content that is offensive, defamatory, infringing, or harmful.

11. Liability

  • Playnist is provided “as is” without warranties of any kind.
  • We are not liable for downtime, bugs, or user-generated content.
  • To the extent permitted by law, we are not responsible for indirect, incidental, or consequential damages arising from your use of Playnist.
  • Nothing in these Terms limits liability where it cannot be excluded under applicable law.

You agree to indemnify and hold Playnist OÜ, its affiliates and employees harmless from any claims, damages, legal fees, or losses arising from your breach of these Terms or any User Content you submit.

12. Governing Law

These Terms are governed by the laws of Estonia. Disputes shall be subject to the exclusive jurisdiction of the courts of Estonia.

13. ADDITIONAL Features

Playnist may introduce new features or functionality in the future. Some of these may be offered on a paid basis. If you choose to use any paid features, we will provide clear information about pricing and any applicable terms beforehand.

14. Changes to THESE Terms

We may update these Terms from time to time. When we make material changes, we will take reasonable steps to notify you, such as through the platform or by email.

Minor updates or changes that do not materially affect your rights may be made without specific notice, and the updated Terms will be indicated by a revised “Last modified” date.

By continuing to use Playnist after any updates take effect, you agree to the revised Terms.
